This Privacy Policy explains how Avistacare Health Care Services ("Avistacare," "we," "us" or "our") collects, uses and protects information when you visit avistacaregroup.com (the "Website"), contact us, or choose to receive text messages from us. By using the Website, you agree to the practices described in this policy.
1. Information We Collect
We collect information that you choose to provide to us, such as when you complete a contact form, request an appointment, apply for a job, subscribe to our newsletter or opt in to receive text messages. This may include your name, phone number, email address, mailing address, the service you are interested in, the content of your message, and any resume or application materials you upload.
When you opt in to text messaging, we also keep records of your consent, including the date, time and method by which consent was given, and information about your interactions with our messages, such as replies and opt-out requests.
Like most websites, we may also automatically collect limited technical information when you visit, such as your browser type, device type, pages viewed, referring website and approximate location based on IP address. This information helps us understand how the Website is used and improve it.
2. How We Use Your Information
We use the information we collect to respond to your inquiries, schedule appointments and consultations, provide information about our home care services, review employment applications, send newsletters you have subscribed to, and send text messages consistent with the preferences you selected when opting in.
We also use information to operate, maintain and improve the Website, to comply with applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA), and to protect the rights, safety and property of Avistacare, our clients and others.
3. Health Information
Please do not submit detailed medical information through the Website’s general contact forms. Protected health information that we receive in the course of providing care to our patients is handled in accordance with the Health Insurance Portability and Accountability Act (HIPAA) and other applicable laws, and is described in our separate Notice of Privacy Practices, which is provided to patients and is available on request.
4. Text Messaging (SMS) Consent
If you opt in to receive text messages from Avistacare, your consent applies only to Avistacare. Your consent is not shared with, and does not extend to, any third party or affiliate unless you provide separate consent. Consent to receive text messages is not a condition of receiving any service.
Message frequency and rates. Message frequency varies depending on your interactions with us. Message and data rates may apply according to your mobile carrier’s plan. Avistacare is not responsible for charges from your carrier.

We do not sell your personal information, and we do not share your mobile phone number or text messaging consent with third parties for their own marketing purposes. We may share information with trusted service providers who help us operate the Website, deliver text messages or email, or process applications, and only as needed for them to perform those services on our behalf.
We may also disclose information when required by law, to respond to legal process, to protect the rights and safety of our clients, staff or others, or in connection with a merger, acquisition or sale of all or part of our business.
You may also register your phone number with the National Do Not Call Registry. We honor applicable do-not-call requirements.
